1. What is Proposition 65 (Prop 65)?
Prop 65 is what is known as a "right to know" statute. The California voters enacted Prop 65 in 1986 as the Clean Drinking Water and Toxic Enforcement Act to require companies to provide "reasonable warning" to consumers if their products contain a chemical determined by the State of California to cause cancer or reproductive toxicity. Prop 65 was enacted in response to consumer concern about the introduction of chemicals into the environment and thus the drinking water. Inclusion of a warning on a product does not mean the product is unsafe but rather only signifies to the consumer that the chemical is present in the product.
2. What is the Prop 65 warning?
The statutory warnings required by Prop 65 are derivations, based on the product or chemical, of "This product contains a chemical known to the State of California to cause cancer, birth defects or other reproductive harm."
3. What products require the Prop 65 warning?
Prop 65 has been interpreted to include all consumer goods sold in the State of California and physical locations where the chemicals may be present in the environment.
4. What chemicals are subject to Prop 65 warnings?
Prop 65 requires the State of California to maintain a list if chemicals. This list is frequently amended to add or delete chemicals. The current list can be found at www.oehha.org/prop65.html.
5. When does a company need to include a Prop 65 warning?
If a company sells a product in the State of California that contains one of the identified chemicals at more than the "No Significant Risk Level" or more than 1/1000 of the "No Observable Effect Level" it must include the warning on its packaging or in a manner that provides the consumer notice prior to purchasing the product.
